DMCA Policy

Fresh Homemade Salsa respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond promptly to notices of alleged infringement that are reported to our designated Copyright Agent, identified below.

This policy outlines the procedure for filing copyright infringement claims and for filing counter-notifications if your content has been removed by mistake.

Filing a DMCA Notice of Alleged Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Fresh Homemade Salsa website (freshhomemadesalsa.com) by completing a DMCA Notice of Alleged Infringement and delivering it to our designated Copyright Agent. Upon receipt of the Notice as described below, Fresh Homemade Salsa will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the website.

To file a DMCA Notice, please provide our Copyright Agent with the following information:

  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.

    • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. Provide your full legal name and your electronic or physical signature (typing your full name is sufficient for an electronic signature).

Filing a DMCA Counter-Notification

If you believe that material you posted on the Fresh Homemade Salsa website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent (as identified above) by submitting a written notification.

To file a DMCA Counter-Notification, please provide our Copyright Agent with the following information:

  • Identify the material that has been removed or to which access has been disabled and the location (e.g., URL link) at which the material appeared before it was removed or disabled.
  • Provide your full legal name, mailing address, telephone number, and, if available, an email address.
  • Include both of the following statements in the body of the Counter-Notification:
    • "I hereby state under penalty of perjury that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
    • "I hereby state that I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, for any judicial district in which Fresh Homemade Salsa may be found, and I will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person."
  • Provide your full legal name and your electronic or physical signature (typing your full name is sufficient for an electronic signature).
